    1. Acceptance of Terms

    4. The HotelScope Service

    4.1 Agency Model

    HotelScope operates as a travel agent — not as a hotel or accommodation provider. When you book through HotelScope, you are entering into a contract with the hotel, property, or accommodation supplier ("Supplier") for the underlying accommodation. HotelScope facilitates that transaction on behalf of the Supplier and earns a commission or service fee.

    HotelScope is not the seller, operator, or provider of the accommodation itself.

    4.2 Pricing

    Rates displayed on the Service are provided by third-party Suppliers and are subject to change without notice. A rate is not guaranteed until a booking is confirmed and you have received a written confirmation. HotelScope makes reasonable efforts to display accurate pricing but does not guarantee that any displayed rate will be available at the time of booking.

    4.3 Search Results

    Search results, rankings, and recommendations on the Service may be influenced by commercial relationships with Suppliers. See our [[affiliate-disclosure|Affiliate & Commission Disclosure]] for more information.

    4.4 Affiliate Links

    The Service may include links to third-party booking platforms or hotel websites from which HotelScope may earn a referral fee or commission. Your use of such third-party links is at your own risk and subject to the third party's own terms.


    5. Bookings

    5.1 How Bookings Work

    When you complete a booking through the Service:

    1. You submit your booking request and payment information;

    2. HotelScope transmits your booking to the Supplier;

    3. The Supplier confirms or declines the booking;

    4. If confirmed, HotelScope will send you a booking confirmation via email.

    A booking is not confirmed until you receive a written confirmation email. Do not assume a booking is guaranteed based on a completed payment form alone.

    5.2 Accurate Information

    You are responsible for ensuring that all guest details, check-in/check-out dates, and room selections are accurate before completing a booking. Errors in booking details may not be correctable after confirmation without incurring fees.

    5.3 Supplier Terms

    By completing a booking, you also agree to the applicable terms and conditions of the Supplier (the hotel or property), including their cancellation policy, check-in requirements, and house rules. HotelScope will display the Supplier's cancellation policy at the time of booking where available.


    6. Payments

    6.1 Payment Processing

    All payments are processed securely by our third-party payment processor, Stripe, Inc. HotelScope does not store, collect, or have access to your full payment card number. Stripe's use of your payment data is governed by Stripe's Privacy Policy.

    6.2 Charges

    By completing a booking, you authorize HotelScope (via Stripe) to charge your selected payment method for the total amount displayed at checkout, including any applicable taxes, fees, or service charges.

    6.3 Currency

    Unless otherwise specified, all prices are displayed in US Dollars (USD). If your payment method is in a different currency, your bank or card issuer may apply a conversion fee. HotelScope is not responsible for foreign exchange fees.

    6.4 Price Errors

    In the event of a manifest pricing error (e.g., a hotel room shown at $0 or an obviously incorrect rate), HotelScope reserves the right to cancel the booking and issue a full refund. We will notify you promptly if this occurs.


    7. Cancellations, Modifications, and Refunds

    In general:

    • Free cancellation windows vary by hotel and rate type;
    • Non-refundable rates are not refundable under any circumstances once booked;
    • Modifications to confirmed bookings may not be possible or may incur fees;
    • HotelScope will act as your agent to communicate cancellation requests to the Supplier but cannot guarantee outcomes beyond the Supplier's stated policy.

    8. Prohibited Uses

    You agree not to use the Service to:

    • Violate any applicable law or regulation;
    • Make fraudulent, speculative, or unauthorized bookings;
    • Transmit any malicious code, viruses, or harmful content;
    • Scrape, crawl, or harvest data from the Service without our express written consent;
    • Circumvent, disable, or interfere with security features of the Service;
    • Engage in any activity that disrupts or impairs the Service;
    • Impersonate any person or entity;
    • Use the Service for any commercial purpose without our written consent (e.g., reselling bookings obtained through the Service).

    9. Intellectual Property

    9.1 Our Content

    All content on the Service — including text, graphics, logos, software, and the compilation thereof — is the property of OpenPublic Networks LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

    9.2 Hotel Content

    Photos, descriptions, amenity listings, and other content provided for hotels or properties are supplied by third parties (Suppliers, data providers, or the properties themselves). HotelScope does not own this content and makes no warranty regarding its accuracy or completeness.

    9.3 User Content

    If you submit reviews, feedback, or other content through the Service, you grant HotelScope a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the Service.


    10. Disclaimers

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    HOTELSCOPE DOES NOT WARRANT THAT:

    • THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
    • SEARCH RESULTS WILL BE COMPLETE OR ACCURATE;
    • ANY BOOKING REQUEST WILL BE CONFIRMED BY THE SUPPLIER;
    • HOTEL DESCRIPTIONS, PHOTOS, OR AMENITY INFORMATION ARE ACCURATE OR UP TO DATE.

    HOTEL AMENITIES, PHOTOS, STAR RATINGS, AND DESCRIPTIONS ARE PROVIDED BY THIRD-PARTY SUPPLIERS AND ARE NOT VERIFIED BY HOTELSCOPE.


    11. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPENPU BLIC NETWORKS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

    • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
    • LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL;
    • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE;
    • DAMAGES ARISING FROM THE ACTS OR OMISSIONS OF THIRD-PARTY SUPPLIERS;
    • ANY BOOKING ERRORS RESULTING FROM INACCURATE INFORMATION YOU PROVIDED.

    IN NO EVENT SHALL HOTELSCOPE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO HOTELSCOPE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

    Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.


    12. Indemnification

    You agree to defend, indemnify, and hold harmless OpenPublic Networks LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

    • Your use of the Service;
    • Your violation of these Terms;
    • Your violation of any third-party rights;
    • Any booking made through your account.

    13. Dispute Resolution

    13.1 Informal Resolution

    14. Governing Law

    These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions.
